What does the law say about working on weekends?

All workers are entitled to get at least one full day (24 hours) off per week, normally on Sunday. If an employer asks employees to work at the weekends, he must pay extra 100% for working overtime.

Employers may give the weekly time off by rotating the day off among the staff.

If working on Sunday is a necessary part of the business operation, the employer must arrange one of the following:

1)    Give all staff rest on a day other than Sunday.
2)    Rest from Sunday noon to Monday noon, or
3)    Rest by rotating all staff. Necessary authorizations must be requested fromthe Ministry of Labor and Vocational Training

What does the law say about working on special days?

The law says that the employer should not unreasonably refuse special leave, such as when the employee is getting married, his wife gives birth, his child is getting married, or his relative have died or is seriously ill.

The maximum number of days a worker can take off for special days is 7 days per year. If employees have not already used their annual leave, their employer may deduct special leave from the remaining annual leave. But if the employees have no annual leave, the employer may require them to work to make up for their special leave.

Which days are national holidays?

Every year, the Ministry of Labor issues a Prakasthat sets the dates for all paid national holiday in Cambodia for that year.

Are employers required to pay workers for work on national holidays?

A paid national holiday cannot be counted as annual leave.Employers must pay employees their normal wages for national holidays. Employers who run businesses that cannot stop operating on national holidays may ask employees to work on these days. This work must be voluntary.

 How much compensation for working on national holidays?

An employer must pay employees their regular wage plus 100% for working on a national holiday and/or weekly day-off. This means that they get one extra day's pay on top of their normal day.

For example: Assume you are paid $2 per day by your employers. If your employer asks you to work on a national holiday, your pay for that day would be $4 ($2 of regular wage plus $2 for the national holiday).

Are there special rights for special groups - youth, elderly, and women?

There are no special rights related to holidays for special groups like youth, elderly, as well as, women.

What is said in collective agreements about working on weekends and special days?

Current collective bargaining agreements are in line with the labor law and do not provide any significant differences.
